1. Acceptance of Terms

By accessing and using Mini Empire: Hero Never Cry ("the Game") and the miniempireheroes.com website ("the Website"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

Mini Empire Studios reserves the right to update these Terms of Service at any time without prior notice. Your continued use of the Game or Website following any changes indicates your acceptance of the new terms.

2. Use License

Permission is granted to temporarily download one copy of Mini Empire: Hero Never Cry on your personal device for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials;
  • Use the materials for any commercial purpose or for any public display;
  • Attempt to reverse engineer any software contained in Mini Empire: Hero Never Cry;
  • Remove any copyright or other proprietary notations from the materials;
  • Transfer the materials to another person or "mirror" the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Mini Empire Studios at any time.

3. In-Game Currency (BS - Bonus Score)

Mini Empire: Hero Never Cry features an optional in-game currency called BS (Bonus Score). By purchasing or using BS, you acknowledge and agree to the following:

  • Virtual Currency: BS is a virtual, in-game currency with no real-world monetary value. BS cannot be exchanged, refunded, or converted into real money or any other form of credit.
  • Welcome Bonus: New players receive 100 BS as a welcome bonus. This bonus is provided at Mini Empire Studios' discretion and may be modified or discontinued at any time.
  • Purchase Terms: All purchases of BS are final and non-refundable, except as required by applicable law. Prices for BS range from $0.99 to $99.99 USD per item.
  • License Only: When you acquire BS, you receive a limited, non-transferable, revocable license to use such BS within the Game only.
  • Expiration: Mini Empire Studios reserves the right to manage, modify, or eliminate BS at any time, with or without notice.

4. User Accounts and Responsibilities

To access certain features of the Game, you may be required to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials;
  • All activities that occur under your account;
  • Notifying Mini Empire Studios immediately of any unauthorized use of your account;
  • Ensuring that all information provided is accurate and up-to-date.

You must be at least 10 years of age to create an account and use the Game. If you are under 18, you must have parental or guardian consent.

5. Intellectual Property Rights

Mini Empire: Hero Never Cry and all its contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, design, and the arrangement thereof) are owned by Mini Empire Studios, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The Mini Empire name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Mini Empire Studios or its affiliates. You must not use such marks without the prior written permission of Mini Empire Studios.

6. Prohibited Uses

You agree not to use the Game or Website:

  • In any way that violates any applicable federal, state, local, or international law or regulation;
  • To exploit, harm, or attempt to exploit or harm minors in any way;
  • To transmit any advertising or promotional material without our prior written consent;
  • To impersonate or attempt to impersonate Mini Empire Studios, an employee, another user, or any other person or entity;
  • To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Game;
  • To use any robot, spider, or other automatic device to access the Game;
  • To introduce any viruses, Trojan horses, worms, logic bombs, or other malicious or technologically harmful material;
  • To use cheats, exploits, automation software, bots, hacks, mods or any unauthorized third-party software.

7. Limitation of Liability

In no event shall Mini Empire Studios, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Game;
  • Any conduct or content of any third party on the Game;
  • Any content obtained from the Game;
  • Unauthorized access, use, or alteration of your transmissions or content.

8. Disclaimer

The Game is provided on an "AS IS" and "AS AVAILABLE" basis. Mini Empire Studios makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

10. Changes to Terms

Mini Empire Studios reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
